Terms of Service

Welcome to CallPico. These Terms of Service ("Terms") govern your access to and use of the CallPico iOS, Android, and web applications, as well as related APIs and services (collectively, the "Service"). By creating an account or using the Service, you agree to be bound by these Terms.

1. Service Description

CallPico provides real, carrier-grade phone numbers (local, mobile, toll-free, and virtual) in 50+ countries, layered on top of your existing SIM. The Service includes voice calling, SMS and MMS messaging, voicemail with automatic transcription, a unified inbox across channels, and per-line privacy controls.

Numbers are provisioned through our licensed telecom partners. CallPico is responsible for the software experience; numbers themselves are subject to the rules of the carrier and the regulatory authority of the country to which each number belongs.

2. Eligibility

You must be at least 16 years old (or the age of digital consent in your jurisdiction, whichever is higher) to create an account. By using the Service you represent that you meet this requirement and that you have the legal capacity to enter into binding agreements.

3. Accounts

You are responsible for safeguarding the credentials used to access your account and for any activity that occurs under your account. CallPico is not liable for losses resulting from unauthorized use of an account when the user has not taken reasonable steps to keep credentials secure.

Notify us immediately at security@callpico.io if you believe your account has been compromised. We may suspend any account that exhibits signs of compromise while we investigate.

4. Subscriptions, Billing & Refunds

CallPico offers monthly subscription plans and pay-as-you-go credit packs. Plans renew automatically each billing cycle until cancelled. You can cancel any time in the app; cancellation takes effect at the end of the current billing period and there are no early-termination fees.

Number rentals (the monthly cost of holding a specific phone number) are refundable within 7 days of the initial purchase if the number has not been actively used. Beyond that window, unused number rentals are non-refundable. Pay-as-you-go credits are non-refundable once consumed.

5. Phone Numbers & Porting

Phone numbers are licensed to you for the duration of your active subscription. CallPico may reclaim a number if (a) your subscription is cancelled or your account is closed, (b) the number is unused for 60 consecutive days, or (c) regulatory authorities or carriers require its return. We will make reasonable efforts to notify you in advance.

Number porting (in and out) is supported in every country we operate in. Porting requires verification of ownership and may take 1 to 10 business days depending on the originating carrier. Numbers being ported out remain active on CallPico until the port completes.

6. Acceptable Use Policy

You agree NOT to use the Service for:

  • Unsolicited bulk messaging (spam), commercial SMS without prior consent, or any form of SPIT (Spam over Internet Telephony).
  • Automated dialing, robocalls, or any system that delivers a pre-recorded message without a real-time recipient interaction, except where expressly permitted under applicable law (for example, TCPA-compliant prior express consent).
  • Harassment, threats, hate speech, sexual content involving minors, or any unlawful, fraudulent, or deceptive communications.
  • Distribution of malware, phishing links, or content that infringes intellectual-property rights.
  • Activity that violates the rules of the carrier or regulator in the jurisdiction of any number on your account, including misrepresenting your identity or the origin of a call or message.
  • Reselling, sublicensing, or providing the Service to third parties without a written agreement with us.

We monitor for carrier-level abuse signals (for example, spam complaints, fraud reports, regulator notices) and may suspend or terminate any line, number, or account that triggers them. Serious violations may also be reported to the relevant authorities.

7. Intellectual Property

CallPico and its licensors own all rights, title, and interest in the Service, including all software, designs, trademarks, and documentation. You retain ownership of any content you send through the Service (messages, voicemails, contact details). You grant CallPico a non-exclusive, worldwide, royalty-free license to host and process your content solely to provide the Service.

8. Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your data. By using the Service, you consent to the data practices described in the Privacy Policy.

9. Termination

You may stop using the Service at any time and delete your account from within the app. We may suspend or terminate your access to the Service if you breach these Terms, the Acceptable Use Policy, or applicable law; if your account is inactive for an extended period; or if continued provision becomes legally or technically infeasible.

Upon termination, your data is handled as described in the retention section of our Privacy Policy. Numbers are released back to the carrier; pending message and voicemail data is deleted within 30 days.

10. Disclaimers

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. To the maximum extent permitted by law, CallPico disclaims all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted service, or accuracy of transcripts.

CallPico is NOT a substitute for a traditional landline phone and is NOT intended for emergency calls. Emergency calling availability varies by country and number type; please consult the relevant in-app notice before relying on the Service for emergency communications.

11. Limitation of Liability

To the maximum extent permitted by law, CallPico's aggregate liability arising out of or related to the Service is limited to the greater of (a) the amount you paid us in the 12 months preceding the event giving rise to the claim, or (b) USD 100.

In no event will CallPico be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including lost profits, lost business opportunities, or loss of data, even if we have been advised of the possibility of such damages.

12. Indemnification

You agree to defend, indemnify, and hold harmless CallPico and its affiliates, officers, employees, and partners from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to (a) your use or misuse of the Service, (b) your breach of these Terms or the Acceptable Use Policy, or (c) your violation of any third-party right or applicable law.

13. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Israel, without regard to its conflict-of-laws principles. Any dispute arising out of or related to the Service or these Terms shall be submitted to the exclusive jurisdiction of the competent courts of Tel Aviv-Yafo, Israel.

Nothing in this section prevents either party from seeking interim relief in any court of competent jurisdiction or limits any mandatory consumer rights you may have under your local law.

14. Modifications to These Terms

We may update these Terms from time to time. For material changes, we will provide notice in-app and by email at least 30 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms. If you do not agree to the revisions, you may stop using the Service and delete your account.

15. Miscellaneous

These Terms, together with the Privacy Policy, constitute the entire agreement between you and CallPico regarding the Service and supersede any prior agreements. If any provision is found unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision is not a waiver of that right or provision. You may not assign these Terms without our prior written consent; we may assign them to an affiliate or in connection with a merger or sale.
